Lasting Power of Attorney

Lasting power of attorney only takes effect if you can’t make decisions for yourself. Lasting power of attorney can apply to property, financial, health and welfare decisions. On the other hand, ordinary power of attorney can take effect while you still have mental capacity, but only applies to financial and property affairs. Why grant lasting power of attorney?
There are many reasons to grant lasting power of attorney. You must apply for an attorney while you still have mental capacity, so once it becomes clear that you will need one, it may already be too late. If you like to be prepared, or if you have any concerns about your future health, then choosing an attorney now can be a wise idea.

Who can I give power of attorney to?
It is your choice who you give power of attorney to, though there are some restrictions. Your attorney will need to be over 18 and they must have the mental capacity to make their own decisions. If someone is bankrupt or subject to a Debt Relief Order, then they cannot be granted an LPA for financial and property affairs.

Otherwise, the choice is up to you. You may wish to grant power of attorney to a friend, partner, relative, or solicitor.

Can I have more than one attorney?
Yes, you can grant power of attorney to more than one person. However, this can lead to complications. When you appoint them, you’ll decide if decisions need to be made separately or together (you can apply different rules to different decisions). If you decide that a decision needs to be made jointly, then all parties must be in agreement for a decision to be finalised.

Before granting power of attorney to multiple people, it can be helpful to seek legal advice on what your options are.

Can I revoke power of attorney after granting it?
Yes, if you still have mental capacity and want to revoke your attorney’s right to make decisions for you, you can end your LPA. You will need to contact the Office of the Public Guardian with a partial deed of revocation.

Do LPAs apply to the whole UK?
